HYDROSEAL OÜ E-SHOP GENERAL TERMS AND CONDITIONS

1. Scope and validity of the Terms

1.1. The Terms and Conditions apply to all legal relations between any person and Hydroseal OÜ, the owner of the e-shop on Hydroseal’s website (hereinafter referred to as the e-shop), in relation to the sale and purchase of products via the e-shop.
1.2. In addition to these terms and conditions, legal relations arising from the sale and purchase of products via the e-shop shall be governed by the laws in force in the Republic of Estonia.
1.3. Hydroseal OÜ is entitled to amend and supplement these terms and conditions if necessary due to the development of the e-shop and in the interests of better and safer use of the e-shop. Changes and amendments to the Terms and Conditions shall be notified to customers via the website www.hydroseal.ee and changes and amendments to the Terms and Conditions and the Price List shall enter into force upon publication of the respective change or amendment on the website www.hydroseal.ee/tingimused. Hydroseal OÜ is also entitled to modify the price list of its e-shop. If the Customer has placed an order before the entry into force of the amendments to the Terms and Conditions or the Price List, the legal relationship between the Customer and Hydroseal OÜ shall be governed by the Terms and Conditions and the Price List in force at the time the Customer placed the order, unless otherwise provided by law or these Terms and Conditions.

2. Price of goods

2.1. The prices in the e-shop are subject to point 4.3 of these Terms and Conditions. subsection 1) or 2) within the time limit for payment of the invoice.
2.2. All prices include VAT 22%.
2.3. If the customer chooses “Hydroseal OÜ transport” as the delivery method, the cost of transport will be added to the purchased products, calculated according to the dimensions, weight, quantity and delivery address indicated in the order. The cost of the transport will be added to the invoice issued to the customer. It is also possible for the customer to collect the goods themselves. In this case, the cost of transport will not be added to the invoice.

3. Shopping cart and placing an order

3.1. The contents of the customer’s shopping cart will be updated the moment he/she clicks on the “ADD TO CART” button.
3.2. You can change the number of products in your shopping basket on www.hydroseal.ee/ostukorv under the “QUANTITY” section. In order to place an order, you must click on the button “CONFIRM ORDER”. The customer will then be redirected to the checkout page.
3.3. On the order form, you must enter the required information and click on the “SUBMIT ORDER” button. The customer’s order is then sent to our customer service representative, who reviews the order and issues an invoice based on the order. The invoice will be sent to the e-mail address provided by the customer.
3.4. When filling in the fields on the order page, it is worth paying the utmost attention, as the accuracy and correctness of this information is crucial for the prompt and trouble-free delivery of the products purchased by the customer.
3.5. The contract for the purchase and sale of the Products shall be deemed to be concluded (entry into force of the Contract) from the date of receipt in full of the amount indicated on the invoice to the account of Hydroseal OÜ.

4. Payment for products

4.1. The invoice on which the payment is based will be sent together with the order confirmation by e-mail to the e-mail address provided by the customer. Before paying the invoice, please check that the information on the invoice matches the information on the order.
4.2. Products can be paid for in a way and at a time that suits the customer (e.g. by bank transfer, at a bank branch, at an ATM).
4.3. Payment of the invoice for the products is made in advance. 100% of the invoiced amount is due and the invoice can be paid within 7 days of the invoice date.
4.4. The customer’s order and invoice will be cancelled if the customer has not paid the advance payment within 7 days from the date of the invoice.
4.5. The sales invoice will be delivered to the customer by e-mail after full payment of the invoice.

5. Delivery and delivery of products

5.1. After the entry into force of the Contract in accordance with clause 3.5 of these Terms. the products are delivered to the customer at the invoice address provided by the customer when placing the order, or at the delivery address if an address other than the invoice address is indicated for delivery. The customer will also be contacted via the contact telephone number provided in the letter at a pre-arranged time in order to clarify the details of the delivery.
5.2. The Products, together with the Estonian language product information and other documents pertaining to the Products, shall be delivered by the carrier no later than the time specified in clause N of these Terms and Conditions, unless another suitable time has been agreed with the Customer.
5.3. In the event that the product ordered by the Customer is not currently in stock and must be specifically ordered from the supplier and it is evident that the delivery of the product within the specified delivery time is not possible, and in other cases where the timely delivery of the products is not possible due to circumstances for which Hydroseal OÜ is not responsible, we will notify the Customer by the contact telephone number or e-mail provided by the Customer when placing the order within 2 working days of the entry into force of the Agreement in accordance with clause 3.5 of the Terms. and we will also inform you of the new delivery date for the product ordered by the customer. In the event that the customer loses interest in purchasing the product due to a longer delivery time, the customer has the right to cancel his/her order (see in more detail in sections 6.1. and 6.3.) and the amount paid by the customer (including the cost of transport) will be refunded to the customer.
5.4. Once the products ordered by the customer have been handed over to the transport company, the transport company will contact the customer in advance to specify the time of delivery of the products.
5.5. The carrier delivers the products to the address indicated by the customer when placing the order. Subsequent changes of destination are possible by agreement and subject to availability.
5.6. We ask you to ensure that the contact details you provide when placing your order are correct to avoid delays and misunderstandings in the delivery of the products. Hydroseal OÜ and the transport company shall not be liable for any delay in the delivery of the products and any misunderstandings caused if the delay or misunderstanding is due to inaccuracy or incorrectness of the information provided by the customer when placing the order.
5.7. The products are handed over to the customer by courier with a delivery note. Before signing the delivery note, we strongly recommend that you check the condition of the goods ordered and, in the event of external damage, make a note to this effect on the delivery note. We also ask the customer to immediately report a damaged product by e-mail to info@hydroseal.ee or by contacting Hydroseal OÜ on +372 7 303 733. Goods damaged by the carrier will be replaced by an equivalent.

6. Cancellation of the order and return of the product

6.1. The Customer has the right to cancel the order after the payment for the products but before the delivery of the products by sending an e-mail to Hydroseal OÜ at info@hydroseal.ee with the invoice reference number and his/her bank account number or by calling Hydroseal OÜ at +372 7 303 733.
6.2. After receipt of the products, the customer (Consumer in the meaning of the LOA) has 14 days to familiarise himself with the products. If the products are not suitable for the Consumer, the Consumer has the right to cancel the order and return the products purchased by filling in a complaint form within 14 days of delivery.
6.3. In the event of cancellation of the order in accordance with clause 4.4 or clause 6.1 or withdrawal from the order in accordance with clause 6.2, the amount paid by the customer for the purchase (together with the transport costs) will be refunded to the bank account indicated by the customer within 14 days of the receipt of the notice of withdrawal from the order, except for clause 6.4 of these Terms and Conditions. in the cases set out in.
6.4. If the product to be returned is damaged and the damage is caused by circumstances beyond Hydroseal OÜ’s control, or if the damage is the result of improper use of the product, Hydroseal OÜ has the right to offset the loss in value of the product against the amount paid by the customer for the product and due to be returned to the customer. Hydroseal OÜ will send the customer an offsetting statement to the e-mail address provided by the customer when placing the order. In case the customer does not agree with the depreciation indicated in the set-off notice, the customer has the right to have an independent expert involved to determine the depreciation of the product. Costs related to the expert opinion shall be divided in half between the client and Hydroseal OÜ, unless the position of one of the parties proves to be unfounded. In such a case, the costs of the expert’s report are borne by the party whose opinion was found to be unfounded.

7. Warranty and return of non-compliant products

7.1. Hydroseal OÜ shall be liable for any non-compliance or defects in the products which become apparent within 2 years after delivery of the products to the customer.
7.2. Hydroseal OÜ is not responsible for:
1) damage to or damage to the product caused by the customer;
2) defects resulting from irregular use of the product;
3) normal physical wear and tear of the product under normal use.
7.3 In the event of non-compliance or defects in the product, the customer must fill in the complaint form ( Product_complaint_form.pdf ) within 2 months of the discovery of the non-compliance or defect in the product. Failure to comply with this time limit without good reason will result in the customer losing the right to invoke the non-conformity of the product.
7.4. In the event of non-compliance or defect of the product, the customer has the right to request the replacement of the product with a compliant and faultless product or to cancel the order and return the non-compliant product at Hydroseal OÜ’s expense.
7.5. In the event of a non-compliant product being returned, the amount paid for the product (including the transport costs) will be credited to the bank account indicated by the customer within 30 days of receipt of the cancellation and the request for return of the product.
7.6. In addition to the rights under the guarantee, the customer also has other rights under the law.

8. Liability and force majeure

8.1. Hydroseal OÜ shall be liable to the Customer and the Customer shall be liable to Hydroseal OÜ for any damage caused to the other party by breach of these Terms and Conditions in the cases and to the extent provided by the legislation in force in the Republic of Estonia.

8.2. Hydroseal OÜ shall not be liable for any damage caused to the customer or for any delay in the delivery of the product if the damage or delay in the delivery of the product is due to a circumstance beyond Hydroseal OÜ’s control and which Hydroseal OÜ did not foresee and could not have foreseen (force majeure).

9. Other conditions

9.1. All personal data of the customer disclosed during the visit to the e-shop and during the purchase will be treated as confidential information. Hydroseal OÜ does not disclose the data it has received to third parties, and the customer has the right to request the deletion of their data from the e-shop database.
9.2. Issues not specifically resolved in these Terms and Conditions shall be governed by the laws and legislation in force in the Republic of Estonia.
9.3. Disputes arising between the customer and Hydroseal OÜ in connection with the purchase and sale of products via the e-shop shall be settled by negotiation. If an agreement is not reached, the customer has the right to turn to the Consumer Protection Board or Tartu County Court to protect their rights. Disputes will be settled in accordance with the legislation in force in the Republic of Estonia.
